Terms of Service

Welcome to Lumio. These Terms of Service ("Terms") govern your use of the Lumio mobile application ("App") provided by The Lumio Teams ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use Lumio. By using the App, you represent that you meet this age requirement. If you are under 18, you must have parental or guardian consent.

• You sign in using your Apple ID. You are responsible for maintaining the security of your account.
• You may only create and use one account.
• You are responsible for all activity that occurs under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

Lumio is an AI-powered photo and video generation service. You upload a photo, select a style, and our AI generates styled images or videos based on your photo. The generation process consumes credits.

• Credits are the virtual currency used to generate AI content within the App.
• Credits can be obtained through: welcome gifts, subscriptions, or in-app purchases.
• Credits are non-transferable and cannot be exchanged for cash or any monetary value.
• Credits have no expiration date while your account is active, unless otherwise stated at the time of purchase.
• Unused credits from subscriptions do not carry over to the next billing period unless explicitly stated.
• We reserve the right to adjust credit pricing and costs for styles at any time. Changes will not affect credits you have already purchased.

5.1 Subscriptions

• Subscriptions are billed through Apple's App Store on a recurring basis (monthly or annually).
• Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your Apple ID account settings.

5.2 In-App Purchases

• Credit packs are one-time purchases processed through Apple's App Store.
• All purchases are final and non-refundable, except as required by applicable law or Apple's refund policies.

5.3 Price Changes

We may change subscription prices or credit pack prices at any time. Price changes for subscriptions will take effect at the start of the next billing period following notice of the change.

6.1 Your Photos

• You retain ownership of the photos you upload.
• By uploading a photo, you grant us a limited, non-exclusive license to process, transmit, and store the photo solely for the purpose of providing the AI generation service to you.
• You represent that you have the right to upload any photo you submit, including the consent of any identifiable individuals in the photo.

6.2 Generated Content

• AI-generated images and videos created through Lumio are provided to you for personal, non-commercial use.
• You may save, share, and post generated content on social media for personal purposes.
• You may not use generated content for commercial purposes (e.g., advertising, merchandise, resale) without a separate commercial license from us.
• We do not claim ownership of the generated content, but we retain the right to use anonymized, non-identifiable examples of generated content for marketing and service improvement purposes.

6.3 Content Restrictions

You agree not to upload or attempt to generate content that:

• Contains nudity, sexually explicit material, or pornography.
• Depicts violence, gore, or harm to individuals.
• Is hateful, harassing, defamatory, or discriminatory.
• Infringes on any third party's intellectual property or privacy rights.
• Depicts minors in any inappropriate context.
• Is intended to deceive, defraud, or impersonate others (including deepfakes for malicious purposes).
• Violates any applicable law or regulation.

We reserve the right to remove content and suspend or terminate accounts that violate these restrictions without prior notice.

You agree not to:

• Use the App for any illegal or unauthorized purpose.
• Attempt to reverse-engineer, decompile, or disassemble the App or its AI models.
• Circumvent any content filtering, access controls, or usage limits.
• Use automated tools, bots, or scripts to access or interact with the App.
• Resell, redistribute, or sublicense access to the App or its features.
• Interfere with or disrupt the App's infrastructure or other users' experience.
• Attempt to extract or replicate the AI models or their outputs at scale.

• The App, including its design, code, AI models, styles, templates, and branding, is owned by us and protected by intellectual property laws.
• Lumio, its logo, and related marks are our trademarks. You may not use them without our prior written consent.
• These Terms do not grant you any rights to our intellectual property except the limited right to use the App as described herein.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

• AI-generated content will meet your expectations or be free of errors.
• The App will be uninterrupted, secure, or error-free.
• Results will be accurate, reliable, or consistent.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless The Lumio Teams, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the App, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) content you upload or generate.

• You may stop using the App and delete your account at any time.
• We may suspend or terminate your access at any time, with or without cause, with or without notice.
• Upon termination, your right to use the App ceases immediately. Your generated content may be deleted.
• Sections 6.2, 8, 9, 10, 11, and 14 survive termination.

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last Updated" date. Your continued use of the App after the changes take effect constitutes acceptance of the revised Terms. If you disagree with the changes, you should stop using the App.

These Terms are governed by the laws of Singapore, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in Singapore, except where prohibited by law. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

• If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
• Our failure to enforce any right or provision does not constitute a waiver.
• These Terms constitute the entire agreement between you and us regarding the App.
• You may not assign or transfer these Terms. We may assign our rights without restriction.

If you access the App through Apple's App Store, the following additional terms apply:

• These Terms are between you and The Lumio Teams, not Apple. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims related to the App, including product liability, legal compliance, or intellectual property infringement.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
